Even the most amicable divorce can be a difficult and emotionally draining process. Massachusetts has enacted no-fault divorce laws to remove some of the complexities from the process. But there are still numerous matters that must be decided – by you and your spouse if you can agree, or by a court if you cannot: How will you divide your property? Can one of you stay in the house? Who will have custody of the children? What will the parenting plan be? Will one of you have to pay child support and/or alimony to the other? Who will carry the medical insurance for the family? Who will pay the legal fees for the divorce? How will the other debts be paid? How will you handle your income taxes? If you and your spouse can reach an agreement on all of these issues, you can enter into a separation agreement and your divorce will not only be no-fault, it will also be uncontested. Our first goal at Newburyport Family Law is to determine if you and your spouse can reach an agreement.  If you and your spouse are willing to try working things out with a trained mediator, no matter how many issues are in dispute, we suggest you give mediation a chance. However, there will always be those cases that have to be tried in a courtroom before a judge. So, the question is inevitably asked as to whether we can fight for your rights? Of course we can and if the case requires that, we are prepared to make certain the outcome is as close to what you are seeking as the law will allow. We have the expertise necessary to obtain a judgment for you, and we will do so with as few court appearances as possible.
